The petitioners seek the grant of bail in case FIR No. 104 dated 25.5.1996 under Sections 302/324/109/380/148/149 PPC registered at Police Station Lala Musa, District Gujrat, on the ground of the statutory delay.
2. Briefly stated the prosecution case is that the petitioners alongwith seven others co-accused climbed the top roof of the house of the deceased Muhammad Khan with the support of a ladder who was done to death alongwith his wife Mst. Maqsooda Bibi and caused injuries to Mst. Sian Jabeen and Yasar.
3. The learned counsel argued that the petitioners were behind the bars since May, 1996, but their trial had not been concluded so far.
4. On the other hand, the learned counsel for the State and the 'complainant submitted that the trial of the case a likely to commence shortly as the statements under Section 161 Cr.P.C, had already been delivered.
5. We have heard the learned counsel for the parties at length. The bail applications bearing Cr.
Misc. No. 4258-B and Cr. Misc. No. 5757-B of 1998 have already been dismissed by this Court on merits. We feel that instead of considering the question of bail, it would suffice if the trial of the petitioner is expedited. This petition is, therefore, disposed of with the direction to the learned trial Court to conclude the trial of the case within a period of two months under intimation to the Member. Inspection Team, of this Court. The petitioners may, however, review their application if the trial of the case is not concluded within the stipulated period without any valid reasons.
