' SARDAR MUHAMMAD RAZA KHAN, J.--- Qudratullah s/o Khan Momin of Pahar Khel Pakka, having been refused bail by the forum below, has come up this Court seeking his release on bail charged under section 324/34, P.P.C. In case F.I.R. No,92, dated 19 7-1998 of Police Station Ghazni Khel.
2. On 19-7-1998 at 1700 hours Manzoor Ahmed complainant along the his cousin Raza Khan was coming from his house to the Chowk of the. Village but when he reached near a transformer, the present accused along in his brother Gul Zarin appeared on the scene armed with Klashnikov. Both opened fire at the complainant party with which the complainant got hit on his foot.
3. Let the factum of non-recovery of blood and empties from the spot be deferred to be decided at the trial. Suffice it to say for the disposal of present petition that it remains yet to be determined at trail as to which one of the accused fired the effective shot. The effective shot is aimed at the lowest and non-vital part of the body and hence the intentiont' to kill also remains yet to be determined and trial.

Consequently, the petitioner is directed to be released on bail provided a bond in a sum of Rs,80,000 with two local, reliable and resourceful sureties is furnished to the satisfaction of the learned Special Judge, Lakki Marwat. revisions by the competent authorities.
