ORDERMUHAMMAD ASIF JAN, J.- Hameed Ullah petitioner aged about 30 years was arrested on the 9th of January, 1997 and is in jail eversince awaiting his trial which has not yet commenced, in pursuance of a case registered against him vide F.I.R. No. 340/96, dated the 31st of December, 1996, under Sections 324/353/34, PPC at Police Station Jhal Chakian of District Sargodha, regarding an occurrence which allegedly took place on the 31st of December, 1996, at 4-45 p.m. In the area of Mauza Dhreema which is about 3 kilo-meters from Police Station Jhal Chakian where the F.I.R, was lodged on the same day within 20 minutes at 5-15 p.m. By A.S.I. Muhammad Iqbal.

2. No firing is attributed to the petitioner; admittedly he was found to be "innocent" by the Deputy Superintendent of Police of Saddar; besides he is entitled to the benefit of clause(a) of the 3rd proviso to Section 497 sub-section (1) Cr.P.C.

3. Resultantly, the petitioner is granted bail provided he furnishes bail bonds in the sum of Rs.50,000/- with two sureties each in the like amount to the satisfaction of the trial Court.
