1. Petitioner having been convicted and sentenced under sections 302/34 PPC in the case registered vide FIR No. 162 of 14.5.1994 Police Station, Narang Mandi, District Sheikhupura for allegedly exhorting (being empty handed) the co-convict Naseer Ahmad who caused two mouser shot fires landing on Muhammad Amin's chest and abdomen to which he succumbed, to imprisonment for life with a fine of Rs. 5,000/- or to suffer 2 years' R.I. With alike amount of compensation payable to legal heirs of the deceased by the learned Sessions Judge, Sheikhupura vide the impugned judgment dated 30.1.1996 has sought bail pleading lapse of the statutory period perceived by Section 426 Cr.P.C, conjunctively with the role ascribed viz., non-ascription of any overt act.
2. Factum whereof remained uncontested by the State since despite the notice none has opted to join the proceedings; resultantly, granting the application suspending the petitioner's sentence he is allowed bail upon furnishing bond in the sum of Rs. 50,000/- with two sureties each in the like amount to the satisfaction of the Sessions Court concerned.
