ORDER

Statediy, Mst. Sha/.Ia hcrveen and Muhammad Akram were married in v ear 1992. l lowcvcr, the relationship between the. Two became strained and so the applicant'Mst. Shazia Parveen came to the house of her parents _uld filed .,uii for dissolution of marriage in the Court of Mr. Habib-ur- Rehman's, Senior Civil ,fudge/Judge. Family Court, Faisalabad. Respondent also did not lag behind and filed a suit fur rcstitutton of conjugal rights in the C-'curt of Shaukat Ali, Civil judge/Judge, Family Court, Sialko; This is how this petition has come to this Court.

2. Muhammad Akram/respondent who is present in person, he has no exception to this application.

The conduct shown by him is highly appreciable. I With the consent of the parties, this application is allowed with the result that suit for restitution of conjugal rights filed by respondent is withdrawn from the Court of Mr. Shaukat Ali, Civil Judge/Judge, Family Court, Sialkot and is assigned to learned Senior Civil Judge/Judge, Family Court, Faisalabad. The first Court shall send the record to transferee Court as quickly as possible. The parties have undertaken to appear before the Judge, Family Court, Faisalabad on 16-11-1998.

The learned Senior Civil Judge/Judge, Family Court, Faisalabad will ensure that the proper opportunity is given to the parties to have a reconciliation by holding pre and post-conciliation proceedings objectively. This, however, will not preclude him from deciding the suit on merit if pre- conciliation proceedings and post conciliation proceedings fail. The respondent, who is present in person, states that he entertains fear of life at Faisalabad. Copy of the order be sent to S.S.P., Faisalabad with a direction that protection be given to respondent when he goes to Faisalabad to appear in Court. This petition, so, stands disposed of in the above terms.
