It is argued that although the order of termination, dated 8-12-1996 was withdrawn on 25-1-1997 yet neither the petitioner is being taken on duty nor being paid salary.
2. On the other hand, learned Additional Advocate-General submits that the appointment of the petitioner was not made in regular manner, therefore, could not be given effect. Respondent No,3 states that she is holding additional charge and previous D.E.O. (Women), respondent No,5, made number of appointments against one vacancy under the political influence and she is now facing many inquiries. It is added that there was more than one orders against the vacancy, therefore, she did not get the petitioner on duty.
3. It is a matter of great regret that the District Officer of the Education Department to great extent are out of control of respondents No,2. The result is wholesale corruption of every type and coupled with misuse of power by some irresponsible political barons has completely rocked the system. The most funny part is that both are conveniently accusing each other for the destruction of the system. Primarily, it is the duty of the respondent No,2 to ensure that sacred duty of imparting education to the coming generations is discharged in a peaceful, orderly and disciplined atmosphere. If anyone feels that for some reason he is not in a position to discharge his sacred duty he will be doing a favor to the Nation by stepping down and allowing anybody else to accept this challenge. One should not clinger the chair if incapable of discharging his duty for any or variety of reasons. Let copy of the petition along with order be sent to respondent No,1 because it is also his responsibility to see that the each department of Punjab Government is headed by conscious, honest, efficient and men of conviction.
4. Now coming back to the case in hand, so long as the order of appointment of the petitioner holds field, she is entitled to duty and salary. It is made clear that the respondents are liberty to get rid of the so-called illegal order in accordance with law. The petition is disposed of accordingly.
