IHSAN-UL-HAQ CHAUDHRY, J.- This is an application for transfer of the proceedings pending in the Court of Senior Civil Judge, Sargodha. The application was admitted to hearing and the notice was issued to the respondent who entered appearance and contested the petition.
2. The learned counsel for the petitioner argued that his client is working in States. It is added that the mother of the respondent (minor) is a practicing lawyer at Sargodha, therefore, tl\e lawyers are reluctant to appear against her in a personal case. It is added that it is not possible for the petitioner to get justice at Sargodha in the absence of a competent lawyer.
3. On the other hand, the learned counsel for the respondent argued that it is not justification. It is added that the mother of the respondent is active member of Bar and a strong group of lawyers is opposing her. There would not be a difficulty in engaging a counsel.
4. I have given my anxious consideration to the arguments and gone through the record. The admitted position is that respondent is a minor and his guardian ad item is his mother. Therefore, it is not deemed proper and in the interest of justice to transfer the proceedings out of district. It is difficult to accept the arguments that petitioner was not in a position to engage a counsel at Sargodha.
5. The upshot of this discussion is that there is no merit in this petition and the same is dismissed with no order as to costs. However, the learned Senior Civil Judge, Sargodha is directed to decide the matter expeditiously, in any case by 31st of January, 1999. He shall ensure that no unnecessary adjournment is granted to any party. 4
