MIAN NAZIR AKHTAR, J.- Uaqat Ali, petitioner has applied for grant of bail in a case registered against him and one Muhammad Nawaz, vide F.I.R. No. 612, dated 18.12.1998 for an offence under Section 392 of the PPC at Police Station, Factory Area, Lahore.
2. I have heard the learned counsel for the petitioner and the State.
3. The occurrence had taken place on 14.11.1998 and the F.I.R, was lodged qn 18.12.1998 with a delay of one month and for days. The complainant stated that he had been trying to probe into the matter at his own level and had learnt that the petitioner Muhammad Nawaz son of Muhammad Ashiq were involved in the occurrence. He did not disclose as to who had imparted the information to him. Prima fade, the petitioner appears to have been implicated on account of mere suspicion.
During the course of investigation, a sum of Rs.500/- was recovered from the petitioner. This recovery per se, cannot furnish reasonable grounds for believing that the petitioner had committed the offence alleged against him. The question regarding the petitioner's participation in the occurrence requires further probe and inquiry.
4. Therefore, the petition is accepted and the petitioner is allowed bail subject to his furnishing bail bonds in the sum of Rs.50,000/- with two sureties each in the like amount to the satisfaction of Judicial/Illaqa Magistrate, Lahore.
