' Vide Annexure "C" the petitioners-Head Constables of Sialkot District were , selected for training in Intermediate Class (H.Cs.) Course at Police College, Sihala. They were duly medically examined and found fit. However, this recommendation has not been approved by the Deputy Inspector- General of Police, Gujaranwala Range, Gujaranwala vide his order, dated 141-1997, which reads as follows:--
2. On the face of it, the order is devoid of reasons and for the information of the Deputy Inspector- General of Police-respondent, let it be said that where the rights of the people are involved law insists upon passing of a speaking order which means the order which would give reasons and also show the application of mind of the person passing the order. Merely writing "N.F.A." is no order in the eye of law. The same is hereby declared to have been passed without lawful authority and, therefore, of no legal effect. The matter shall be deemed to be pending with respondent-Deputy Inspector-General of Police, who shall proceed to pass appropriate orders in accordance with law, if necessary, after hearing the petitioner, within fifteen days from today.
3. This petition is allowed with the above direction. On the request of the learned Assistant Advocate-General, Punjab, I refrain from imposing costs on the Deputy Inspector-General of Police, Gujranwala Range, Gujranwala.
