IFTIKHAR HUSSAIN CHAUDHRY, J.- Petitioner is one of the accused in case FIR No. 365/97, dated 27.8.1997, under Sections 302/34, P.P.C, registered at Police Station, Saddar Bhakkar.

The prosecution case is in terms that Muhammad Ashraf, Muhammad Khan, Haq Nawaz and Muhammad Riaz emerged from a sugar-cane crop and launched an attack on the complainant party when they were present near their land to irrigate the same. The allegation against Haq Nawaz petitioner is that he find with kalashnikov which hit Muhammad Ashraf, nephew of the first informant on right scapula.
3. Petitioner was arrested and has applied for grant of bail to him.

The investigation was conducted inter alia by Superintendent of Police Khushab, who after due inquiry came to the conclusion that Haq Nawaz had confederated and conspired with the co- accused in the commission of offence, who otherwise was not present on the spot. Muhammad Riaz, a co-accused of the petitioner, who had played a similar role in the incident was enlarged on bail earlier. The case of the petitioner is not distinguishable from that of the co-accused who was granted bail earlier and as such the petitioner is also allowed bail in the sum of Rs.1,00,000/- (Rupees one lac) with two sureties in the like amount to the satisfaction of Sessions Judge, Bhakkar.
