MUHAMMAD ASIF JAN, J.- Faruq Khan petitioner aged about 32 years, was arrested on the 23rd of April 1997, in pursuance of a case registered against him and for others vide F.I.R. No. 209, dated the 11th of April, 1997, under Sections 302/34/109 PPC, at Police Station Uggoke of District Sialkot, regarding an occurrence which took place on the 10th of April 1997, at 8.30 p.m. In the area of village Jallianwala, which is at a distance of about 8 kilometers from the Police Station where the F.I.R, was lodged on the 11th of April, 1997 at 6.20 a.m. By Naseem Akhtar, uncle of Waseem Aslam deceased.
2. The allegation against the petitioner is that while armed with a rifle, he fire at Waseem Aslam deceased as a result of which he died the next day in the Mayo Hospital of Lahore.
3. The allegation against the petitioner brings his case within the prohibition contained in sub- section (1) of Section 497 Cr.P.C, which disentitles him from the grant of bail.
