ORDER

1. Mr. Tariq Shamim, learned counsel for the respondents having entered appearance has objected to the competence and maintainability of this petition on the ground that the Tourism Development Corporation of Punjab Limited is a public company incorporated under the Companies Ordinance, 1984, therefore, the same is not a person within the meaning of the word as defined by sub---Article (5) of Article 199 of the Constitution of Islamic Republic of Pakistan, 1973. In support of his argument, he has referred and relied to the memorandum and articles of association of the Tourism Development Corporation of Punjab Limited. Confronted therewith, learned counsel for the petitioner had nothing to say. It is so obvious from the perusal of the memorandum and articles of association that the Tourism Development Corporation of Punjab Limited is a public Company for all intents and purposes, therefore, does not come within the purview of sub-Article (5) of Article 199 of the Constitution of Islamic Republic of Pakistan, 1973.
