ORDER This is an application seeking modification of the Order dated 15.5.1997 whereby the appellants' were asked to deposit Rs. 3 lac which was the principal amount and furnish security to the extent of remaining decretal amount. The learned counsel for the appellants has contended that there was sufficient security lying with the respondents which may be treated as security for the present purposes also and as such the order passed by this Court may be modified.
2. We are unable to accept this contention of the learned counsel for the appellants. The amount of Rs. 3 lac which the appellants were asked to deposit with the Court was admittedly due and payable as principal amount. Similarly, security which was ordered to be furnished was a condition for admission of the appeal to regular hearing. No plea being now advanced was raised at the time when the order dated 15.5.1997 was passed. It is took late in the day to agitate this matter for the first time.
3. This application is dismissed with the result that, the main appeal also stands dismissed with no order as to costs. revisions by the competent authorities. Therefore, it is advisable to consult the official sources or legal professionals for the most up-to-date and accurate information.
