' MUHAMMAD AZAM KHAN, J.--- This order shall commonly dispose of Criminal Miscellaneous Nos.155 and 158 of 1998, as both have arisen out of the same F.I.R. No,72, dated 2-11-1997 of Police Station Chaudhwan under section 324/353/34, P.P.C. Read with section 13 of the Arms Ordinance, lodged by the complainant Hussain Baldish, respondent No,2, herein, in both the aforesaid petitions.

Suffice it to say that the petitioners are behind the bars since their arrest and their trial had not been concluded in spite of the fact that the trial Court, while dismissing their applications for bail by this Court on 26-2-1998 on merits, was directed to decide the case within a period of three months which had failed to do so, and despite the fact that their trial had not so far been concluded even though a period of more than a year had been elapsed, therefore, the petitioners are entitled to bail on statutory ground, as a matter of right and not grace. As such, both the applications are accepted and the petitioners are admitted to bail provided each of them furnishes a bail bond in the sum of Rs,one lac with two sureties each in the like amount to the satisfaction of the trial Court, who shall see that the sureties are local, resourceful and men of sufficient means. revisions by the competent authorities.
