Petitioners having been arrested in the case registered vide F.I.R. No. 307 of 24.8.1998 under Sections 302, 324, 148, 149, 109, PPC Police Station, Saddar Daska District Sialkot reporting the murder of complainant's maternal cousin Abdur Rauf by fire-arm injuries caused by the spelt out co- accused having conspired with the petitioners have sought bail.

Contending that admittedly neither the petitioners were present at the venue at the time of incident nor names of the persons allegedly hatching their conspiratorial role were cited therein being Maqsood and Amjad whose acclaimed presence at the time of the alleged hatching of conspiracy of the preceding evening in Ashiq Hussain petitioner's Dera being cousins of the deceased patently suffers from inherent incredibility and have been maliciously involved extending the net too wide being elders of the family on which count they have already suffered more than 4 months' internment and with the submission of challan are no more required by the Investigating Agency.
3. Factum whereof remained uncontroverted by the learned counsel appearing on behalf of the complainant as well as the State upon instructions imparted by the police official in attendance equipped with the record.
4. In view whereof the petitioners are allowed bail upon furnishing bonds in the sum of Rs.50,000/- each with two sureties each in the like amount to the satisfaction of the Trial Court concerned.
