MUHAMMAD ASIF JAN, J.- Abdul Haq, petitioner, was arrested on the 10th of February, 1999, in pursuance of a case registered against him vide FIR No. 161/99, dated the 10th of February, 1999, recorded under Sections 161/162/165-A of the Pakistan Penal Code read with Section 5 sub-section
(2) of the Prevention of Corruption Act of 1947, at Police Station, Model Town, District Gujranwala regarding an occurrence which took place on the 10th of February, 1999 at about 7 p.m. In the Office of the Motor Vehicle Examiner situated opposite Sangham Cinema at a distance of two furlongs from the. Police Station where the FIR was lodged on the same day at 7.40 p.m. By Shaikh Majeeb Aslam, Magistrate lst Class.
2. The allegation against the petitioner is that he was present in the office of co-accused Mirza Fayyaz Baig, Motor Vehicle Examiner and some money was recovered from him.
3. Admittedly, Abdul Haq petitioner is not a public servant and, therefore, does not come within the mischief of the offences allegedly committed.
4. At any rate, reasonable grounds to believe that the petitioner is guilty of an offence punishable with death or imprisonment for life or imprisonment for ten years do not seem to exist, grant of bail.
5. Resultantly, the petitioner is granted bail provided he furnishes a bail bond in the sum of Rs.
50,000/- with two sureties in the like amount to the satisfaction of the trial Court. Copy dasti.
