ORDER

SAYED NAJAM-UL-HASSAN KAZMI, J.- Let the statement of Mst. Naseem Akhtar alleged detenue be recorded on oath. The statement of Mst. Naseem Akhtar d/o Bashir Muhammad (detenue) on oath:- "I am 19 years old. I was never married to Rasheed Ahmad, petitioner. I do not want to go with the petitioner. I want to live with my mother Mst. Manzooran who is present in the Court. I do not want to stay at Dar-ul-Aaman."

2. In view of the statement of Mst. Naseem Akhtar, who is major, she is set at liberty. There is no need to send her to Dar-ul-Aaman. She is allowed to go along with her mother. The petitioner may file a suit restitution of conjugal rights, if so advised, which if filed, shall be decided on its own merits.

3. The writ petition is disposed of accordingly.
