' The petitioner, charged under Article 3/4 of the Prohibition (Enforcement of Hadd) Order, 1979, vide F.I.R. No,434, dated 20-6-1997, lodged in Police Station Shabqadar, has been refused bail by the Courts below. He has, therefore, moved this Court for the redress of his grievance and has prayed that he be released on bail.
2. Mr. Ishtiaq Ibrahim, Advocate learned counsel for the petitioner and Mr. Ziaur Rehman, Assistant Advocate-General for the State present and heard. Record of the case perused.

Without touching the merit of the case, at this stage, and taking into consideration the fact that the Laboratory Report, in respect of the contraband articles (Charas), has not been obtained so far, therefore, I am of the view that reasonable grounds do not exist for believing that the petitioner is connected with commission of the offence charged with.
4. This bail application is accordingly accepted and the petitioner shall be released forthwith, if not required in any other case, provided he deposits Rs,25,000, as bail money, in this Court.
