ABDUL HAFEEZ CHEEMA, J.- Through this Constitutional petition Rai Walayat Khan son of Rai Dan Khan Kharar of Chak No. 379/GB, P.S. Lundianwala, Tehsil Jaranwala, District Faisalabad seeks a direction from this Court against the local police that they be restrained from unduly harassing him. It is stated by the petitioner that he is a gentleman and is. Living peacefully in his village. The local police, has been unnecessarily raiding his house just to harass him for ulterior gains and at various occasions have received illegal gratification of over Rs. 22,000/-. He had approached the police hierarchy but no relief has been provided to him so far.
2. The matter was referred to Haji Mukhtar Ahmad, Inspector, Range Crime, Faisalabad. He has submitted a detailed report. According to his report the petitioner is involved in many cases of theft of motor-cycles and is a crafty man. He invariably files petitions against police officers just to harass them. No substance was found in his contentions and the Inspector ultimately reported that the writ.
3. Learned counsel for the petitioner states that the inquiry held by Haji Mukhtar Ahmad, Inspector was ex parte and the petitioner was never associated.
4. It is submitted by the learned A.A.G, that the petitioner was summoned by the Inspector to appear before him on 21-5-1997 but he failed to tum up despite his service. As such the Inspector was obliged to conduct the inquiry without associating him. This was a deliberate attempt of the petitioner not to appear in order to create a ground for entrustment of the inquiry to some other officer.
5. Arguments have been heard and record perused.
6. The Inspector is known for his integrity and uprightness. There is nothing on the record to doubt the veracity of the inquiry. As such I find that the writ petition is baseless and is hereby dismissed.
Let the cases against the petitioner, if any, be investigated fairly.
