' JAWAID NAWAZ KHAN GANDAPUR, J.---Vide Office Order No,12505-7/DGA, dated 8-10-1987 the petitioner was appointed as an untrained Field Assistant in the Agriculture Research Institute, Tarnab, Peshawar on temporary basis. Later, on 20-1-1997, his services were terminated by the Director-General (respondent No,3) vide his Order No,500-11/Estt: DGA, dated 20-1-1997 with effect from 31-1-1997.

Aggrieved by the said order of respondent No, 3, the petitioner has approached this Court by filing this Constitutional petition under Article 199 of the Constitution of Islamic Republic of Pakistan, 1973 for the redress of his grievance because according to him, the impugned order dated 20-1- 1997 is without jurisdiction/illegal and therefore, liable to be set aside.
3. Mr. Ijaz Anwar, Advocate, learned counsel for the petitioner present and heard. Record of the case perused carefully.
4. It may be stated at the very outset that this writ petition is not maintainable and, thus, liable to dismissed. The order dated 8-10-1987 vide which the petitioner was appointed reads:-.
OFFICE ORDER ' dated Tama, the /1987.
' Mr. Muhammad Saddiq Shah son of Mian Ashrafullah, is hereby appointed as untrained Field Assistant on temporary basis in BPS-6 (Rs,725--28--1,285) plus usual allowances as admissible under the Rules.
' He is posted against an existing vacancy of Field Assistant in Vegetable Maximization Project, in N.W.F.P., A.R.I., Tarnab.
(1) The appointment is purely temporary/stop-gap/ad hoc arrangement and services be terminated at 14 days' notice without any reasons being assigned any time irrespective of the fact that he is holding a post other than the one to which he was originally recruited and on payment of 14 days' salary in lieu of the notice.
(2) In case he wishes to resign at any time, 14 days' notice will be necessary or in lieu thereof, 14 days' pay shall be forfeited.
(3) He will have to produce a medical fitness certificate before joining his duties.
(4) He will be governed by such rules and orders relating to leave, Travelling Allowance, pay etc. As may be issued by the Government for the category of Government servants to which he will belong.
(5) He will be liable to be transferred anywhere in N.W.F.P.
(6) He will not claim lien in the Research Wing of the Agriculture Department on termination of the scheme.
(7) No T.A./D.A. Will be granted for joining the duty.
' If he accepts the post on the above terms and conditions should report for duty to the Incharge Vegetable Maximisation Project in N . -W. F.P. , at A . R . I. Tarnab (Peshawar).

In the circumstances, we fail to understand as to how could the petitioner invoke the Constitutional jurisdiction of this Court to challenge the validity of the impugned order, passed in accordance with the terms of the agreement/appointment letter which was duly accepted/acted upon by the petitioner. The petitioner is estopped by his own conduct to bring this petition.
6. The petition being without any substance is dismissed in limine.
