1. SHARIF HUSSAIN BOKHARI, J.-~ Rauf Chishti, Inspector/SHO, Police Station Chunian, who is present in person, states that the alleged date Muhammad Hamza son of Bhudan Khan was neither arrested nor confined at Police Station Chunian. He, however, explains that Layshaft, mother of the petitioner Nadir Khan, made .An application to SHO complaining against the petitioner about taking money from her for developing and irrigating land within the District of Bhakkar. This application was marked by the SHO to SI Abdul H. Aq of Police Station Chunian. He further states that Muhammad Nadir Khan, the petitioner, was called by SI Abdul Haq at Police Station who was accompanied by Muhammad Hamza, the alleged date. Muhammad Nadir Khan, the petitioner, requested for time to settle the dispute with his mother Mst. Aysha. The same day they entered into settlement which was also briefly reduced into writing on 6-3-1997. This bears the signatures of Mst. Aysha, petitioner Muhammad Nadir Khan, Muhammad Hamza and Gulbadan, sister of the petitioner. According to this writing the settlement was partially finalised and partially was to be finalised by them..
2. According to the settlement, on 8-3-1997 the petitioner Nadir Khan and his mother Mst. Aysha came to Police Station Chunian. On that day Mst. Aysha and her daughter Mst. Gulbadan from the one side and Muhammad Nadir Khan, the petitioner, alongwith Muhammad Hamza, the alleged date, came from the. Other side to Police Station. In pursuance of the settlement between the parties, Muhammad Nadir Khan, the petitioner, brought Tractor to Police Station and handed-over the same to SHO and asked him to retain the Tractor at Police Station- till the time it was registered in the name of his mother Mst. Aysha. The Tractor is still lying at the Police Station due to the pendency of this writ petition. However, Mst. Aysha has obtained the order for ' Superdari' from the learned Magistrate.
2. According to the statement of the SHO Police Station Chunian. The alleged date Muhammad Hamza was neither involved in any case registered at. Police Station Chunian nor was confined at the police station at any time. He, came twice on 6-3-1997 and 8-3-1997 alongwith Muhammad Nadir Khan, the petitioner to police station as explained above. On the written complaint of Mst.
3. Aysha against her son Muhammad Nadir Khan, no further action was taken by the police as the offence disclosed therein appeared to be non-cognizable. The Tractor which was brought to Police Station by Muhammad Nadir Khan, the petitioner, was kept at police station at the request of Mst.
4. Aysha who wanted to get it transferred in her on name. This petition has thus become infructuous in view of the statement made by SHO Police Station Chunian in Court. However if the petitioner feels aggrieved, he may take appropriate action against the respondents in accordance with law.
