JUDGMENTRAJA MUHAMMAD SABIR, J.-- Through this Constitutional petition Muhammad Arshad Javaid petitioner wants this Court to declare the orders of respondents rejecting the petitioner's bid dated 20.2.1990 passed by the learned A. D.C(G) with powers of Deputy Settlement Commissioner, Faisalabad, to be illegal, void and without lawful authority and of no legl effect and to further direct respondent No. 1 to allow the petitioner to deposit l)ie balance amount and issue the title deeds to the petitioner.
2. The brief facts leading to the filling of this petition arc that one Floor Chaki was put into auction by the Settlement Department on 15.9.1984. The petitioner being the highest bidder offered Rs.
6200/- anjl his bid was accepted. He deposited the l/4th bid money. Bid proceedings wereaubmitted to the higher authorities for confirmation but it was ultimately not coptirmed on the ground that no proper Committee for bid proceedings was constituted at the time of auction of the property in dispute, hence vide order dated 20.2.1990, the petitioner was informed that his bid was not confirmed, against which the present writ petition has been filed.
3. Learned counsel for the petitioner submits that inspite of the fact that the bid of the petitioner was accepted on 15.9.1984, title deed of the property has not been issued to him inspite of the fact that repeated applications were submitted by the petitioner to the respondents.
4. Mr: Hamid Ali Mirza. Learned counsel for the Settlement DepartmenLrespondents submits that no proper Committee for auction was constituted at the relevant time, therefore, the bid was not in accordance with law and consequently the Department refused to confirm it. Since the bid proceedings were not held by the competently constituted Committee, hence the refusal by the respondents to confirm the bid does not suffer from any illegality. Respondents are, however, willing to return the money ddjxisited by the petitioner as l/4th of the bid money.
5. From the facts and circumstances of the case it is established "that the Committee was not constituted according to rules, so the bid proceedings themselves were illegal and the Department was justified to decline to confirm the, petitioner's bid in the auction.
6. For the foregoing reasons, I find no justification to interfere in the impugned order, dated 20.2.1990 of the learned A.D.C. (G) with powers of Deputy Settlement Commissioner, Faisalabad.
This petition is dismissed with no order as to costs.
