TANVIR AHMAD KHAN, J.- Petitioner through this application has sought post arrest bail in a case registered vide FIR No. 331-97 dated 3.7.1997, under Sections 10/11 of the Offence of Zina (Enforcement of Hudood) Ordinance, 1979 at Police Station Saddar Kasur.
2 . The aforestated FIR was got recorded at the instance of Muhammad Ali making allegations that on 29.6.1997 Mst. Irshad Bibi \who was on visiting terms took, his daughter Mst. Zobia Khan clandestinely on the pretext of answering the call of nature. The co-accused Tariq Mahmood, Munawar and Muhammad Yasin who were present with their weapons in the fields took her forcibly in a vehicle.
3. Bail is sought on the ground that the petitioner has been implicated in a belate FIR out of enmity and his name does not find mentioned in the FIR.
4. I have considered the contentions. I have noticed that the occurrence in this case is stated to- have taken place on 29.6.1997 while FIR was recorded on 3.7.1997 with specific mention of the alleged abduction by the co-accused under the threat of arms. The name of the petitioner was brought through a supplementary statement recorded on 25.7.1997 simply with the allegation that he at the time of recovery was also found alongwith co-accused. I have also noticed that Mst.
Zobia Khan admitted in her statement under section 164 Cr.P.C, that she contracted marriage with Tariq Mahmood against whom the main allegations are levelled. Even in the investigation conducted by the Range Crime, it had come on record that it was only Tariq Mahmood who allegedly committed Zina bil jabr with the lady. In these circumstances, when initially in this belated FIR petitioner's name was not mentioned and the complainant after about.27 days of the occurrence implicated the petitioner alongwith co-accused in the abduction. There is no allegation of Zina against him. In these circumstances, I am inclined to admit the petitioner to bail provided he furnishes bail bonds in the sum of Rs. 50,000/- with to sureties each in the like amount to the satisfaction of the Judicial Magistrate concerned.
