AHMAD SAEED AWAN, J.-. Khan Muhammad, petitioner, being accused,, in case FIR No. 4, dated 6.1.1996 registered under sections 379/411 PPC read with Section 14 of the Offences Against Property (Enforcement of Hudood) Ordinance, 1979 with Police Station Kundian has filed this petition under Section 497/498 Cr.P.C, for the grant of post arrest bail.
2. The allegation against the. Petitioner is that he alongwith co-accused was found stealing railway material from the railway track between KM 248-250 during the night 5/6:1-1996 valuing Rs.500/-.
3. In support of the petition, learned counsel argued that the alleged stolen property is of the valuing of Rs. 500/- and that the petitioner has behind the bar for the last more than three months.
Further argued that the offences with which. The petitioner has been charged did not fall under the prohibitory clause of Section 497 Cr.P.C, and the petitioner is entitled to the concession. Of bail.
4. Learned counsel for the State has opposed the bail application.
5. I have heard the arguments advanced by the learned counsel for the parties at length and have perused the record with their able assistance. There is substance in the arguments addressed by the learned counsel for the petitioner. Keeping in view the peculiar facts and circumstances of the case, the petitioner is admitted to bail subject to his furnishing bail bonds in the sum of Rs. 30,000/- with to sureties in the like amount to the satisfaction of trial Court.
