ORDER

' The petitioner, Khalid Sarwar, has moved this petition for bail after arrest under section 497/498, Cr.P.C. In a case registered against him under section 302/307/34/109, P.P.C. At Police Station Head Marala vide F.I.R. No,237, dated 27-6-1987.

6. The allegation is that the petitioner while armed with Knuckle duster came and caused injuries on the person of the deceased Safdar Mahmood. Learned counsel contended forcefully that three Investigating Officers in their intensive investigation found the petitioner to be innocent and that he has been placed in column No,2. The Investigating Officer is present with record of the case. He has admitted the contention of the learned counsel to be true. The learned State Counsel has half- heartedly opposed the grant of bail to the petitioner without advancing any cogent reasons. The Investigating Officer has made a candid statement that he has no objection if the petitioner is admitted to bail.

7. I have heard the learned counsel for the parties and have perused the record. It is admitted that the petitioner was found innocent by three Investigating Officers in their intensive investigations.

Respectfully following the rule laid down in Ibrahim v. Hayat Gul and others 1985 SCM R 382, Muhammad Aslam v. The State 1986 PCr.LJ 1392 and Ikram Ullah v. The State 1988 PCr.LJ 294(1), the petitioner is admitted to bail in the sum of Rs,80,000 (Rupees eighty thousand) with two sureties each in the like amount to the satisfaction of the A.C., Daska. The trial Court is directed to conclude the trial of the petitioner within six months without fail.
