KARAMAT JVAZIR BHANDARI, J.- This constitutional petition is directed against the order of single Bench of the National Industrial Relation Commission dated 24.03.1996 by which order, on a petition brought by respondent No. 3. The learned Single Bench of the National Industrial Relation Commission allowed him to retain the Toyota Double Cabin Pickup No. G.A 6075 which as a president of the Union he was entitled to retain. The case of the petitioner is that in fresh election he no more remained the President and, therefore, was not entitled to retain it. Against the order of the Single Bench the appeal was preferred to the Full Bench which is pending but since it could not be straightaway heard, the petitioner has to resort to this constitutional petition seeking suspension of the order of the teamed single Bench. This petition was admitted to regular hearing on 15.01.1997.
The respondent No. 3 in spite of notice has not appeared. He is hereby ordered ex- parte.
2. To a Court question, learned counsel has stated that the Full Bench of he National Industrial Relation Commission is now functioning and the appeal will ae coming up for hearing in due course. In the circumstances, it is directed that the petitioner should pursue the alternative remedy of appeal. However, in the interest af justice, it is ordered that pending decision of the appeal, the interim order of the single Bench dated 24.03.96 shall remain suspended as the same could not have >een passed either in law or in equity. No. Order as to costs.
