MIAN ALLAH NAWAZ, J.- This application, under Section 25-A of the Family Courts Act, 1964 by Mst.
Dr. Uzma, for transfer of a suit for restitution of conjugal rights titled Dr. Muhammad Ikram v. Dr. Uzma' from the Court of Mr. Abdul Qayyum Khan, Family Judge, Faisalabad to that of Mr. Muhammad Tahir Naeem, Family Judge, Lahore, was earlier allowed ex parte by me vide order dated 16.2.1998. Dr. Muhammad Ikram/herein respondent moved a Review Application. No. 4- C/1998 of recalling of the aforesaid order; that the Review Application was accepted with the consent of the parties/restoring this TA to its original position.
2. Briefly, the facts are: that Mst. Dr. Uzma and Dr. Muhammad Ikram were married on 6.3.1997.
Relations between the two became strained soon after the marriage. Feeling aggrieved, Dr. Uzma filed a suit for dissolution of marriage in the court of Mr. Tahir Naeem, Family Judge, Lahore on 2.5.1997. Respondent also filed a suit for restitution of conjugal rights in the Court of Mr. Abdul Qayyum Khan, Judge Family Court, Faisalabad. This is how this application has come to this Court.
3. Learned counsel for petitioner contended that the petitioner is a female; that she is residing at Lahore and that she cannot prosecute her cause at Faisalabad. On the other hand, learned counsel for respondent has vehemently opposed this petition but he could not controvert the above situation.
4. I have heard the learned counsel for parties. Manifestly, petitioner is residing at Lahore and being a lady, she feels hazards in prosecution of her cause at Faisalabad. Taking the above-mentioned circumstances into consideration, I am inclined to allow this application with result that restitution suit is withdrawn from the Court of Family Judge, Faisalabad and is entrusted to Mr. Tahir Naeem.
Family Judge, Lahore. The former Judge shall send the record of suit for restitution of conjugal rights to the transferee Court and transferee Court shall decide the matter as early as possible after affording opportunity of hearing to both the parties.
