RAJA MUHAMMAD KHURSHID, J.- A case under sections 10/11 of the Offence of Zina (Enforcement of Hudood) Ordinance, 1979 was registered against the petitioner allegedly for the abduction of Mist.
Fatima Noreen.
2. Learned counsel for the petitioner has submitted that the abductee exonerated the petitioner during the investigation before the police while stating that she was his legally wedded wife.
Further submitted that the petitioner has been declared innocent in to successive police investigations and the case against him was discharged. However, on the petition of parents of the abductee, the investigation was re-opened which was conducted by DSP, Headquarter.
Muzaffargarh who found him innocent. The aforesaid investigation was confirmed by the S.P.
Muzaffargarh.
3. The learned state counsel has confirmed all the above facts and has submitted that according to the aforesaid police investigation, it is re-commended that the case is liable to be cancelled.
3 In view of the foregoing facts, it has become a case of further enquiry. The petitioner is accordingly allowed and the interim bail granted to the petitioner ride order dated 8.9.1996 is continued. He shall, however, join the investigation as and w hen required by the Investigating Officer in writing.
