SHEIKH RIAZ AHMAD, C.J.- Petitioner Mst. Nosheen Akram and respondent Abdul Rauf were husband and wife but they fell apart from each other. Mst. Nosheen Akram is residing in Lahore and has instituted suits for dissolutions of Marriage, recovery of maintenance, dower and for the custody of the child. In addition to these matters, to criminal cases are also pending in Lahore. It is stated that with a view to harass the petitioner, respondent Abdul Rauf filed a private complaint which is pending in the Court of Ch. Abdul Majid, Judicial Magistrate, Islamabad. This application has been moved to transfer the said complaint to Lahore.
2. Being a woman, it would be inconvenient for the petitioner to move to Islamabad and to contest the complaint there, therefore, the transfer application has substance in it and I would direct that he complaint filed by respondent Abdul Rauf under sections 380/454/506/34 PPC pending in the Court of Ch. Abdul Majid, Judicial Magistrate, Islamabad shall stand transferred to the Court of Mr. Muhammad Ismail, Magistrate at Lahore who has already seized of other cases.
