' The relevant facts of the case are that the Assistant Commissioner/Administrator, Town Committee, Phool Nagar, District Kasur, issued press advertisement for filling various vacancies, including Light Inspector in BS-7 and Court Clerk in BS-5. The petitioner applied for the job of Light Inspector, Court Clerk and Octroi Moharrar and accordingly he was interviewed on 28-12-1995 alongwith other candidates. Since the petitioner was not appointed he filed the present Constitutional petition challenging the order of the respondents Nos. 1 to 3 whereby the petitioner was ignored and respondents Nos. 4 to 6 were appointed.
2. On the direction of the Court merit list and report were submitted by the Deputy Commissioner, Kasur, who was also Chairman of the District Recruitment Committee. According to this list there were 24 candidates for the job of Light Inspector and 18 for the job of Court Clerk. The list shows that the petitioner is the highest qualified amongst all the candidates, who applied for the post of Light Inspector and Court Clerk. The list for Octroi Moharrar has not been placed on record. The petitioner is B.A. In 2nd Division whereas respondent No, 4, who has been appointed as Light Inspector is F.A. In 2nd Division. Similarly respondent No, 5 who has been appointed as Court Clerk is a Matriculate.

From the merit list prepared by the District Recruitment Committee it is evident that the petitioner was the highest qualified amongst the candidates who had participated in test and appeared in interview also. There is nothing on record to show that there was anything against the petitioner which disentitled him to be appointed against any of the three jobs for which he had applied. Respondents Nos. 1 to 3 are, therefore, directed to reconsider the case of the petitioner and appoint him against one of the jobs for which he had applied for in accordance with his qualification and merits. With this direction the writ petition stands disposed of.
