DECISION This is a Review Petition against the order dated 1-6-1995 declaring respondent Nazeer Hussain to be a Checker and therefore falling under the definition of worker according to the Schedule in Workmen's Compensation Act.
2. It has been argued that he was originally a conductor. He was promoted as Traffic Supervisor. Mr. Wahid Bukhsh Shaikh for the respondent states that the work of Traffic Supervisor and checker were identical and by Traffic Supervisor is meant checker and he therefore continued to be a worker and the case regarding him did not abate as already ordered. However that is a matter of evidence. The order of abatement concerning these proceedings cannot be passed in this case and the Review Application is accordingly dismissed.
