This is an application for bail before arrest moved on behalf of the petitioner in a case F.I.R. No.89 dated 13-3-1995 for the offences under sections 302, 109/34, P.P.C., registered at Police Station Sadar Dunyapur, District Lodhran.
2. Succinctly the prosecution case is that when Muhammad Saleem was found dead in the room, the petitioner was present in the courtyard of that house.

4. No overt act had been attributed to the petitioner. Her mere presence in the courtyard did not necessarily mean that she contributed to the death of deceased Muhammad Saleem. The petitioner is a woman and her case falls within the proviso of section 497, Cr.P.C.
5. In view of above, the interim bail already granted to the petitioner is hereby confirmed.
