1. MUHAMMAD ASLAM ARAIN, J.---We have heard the learned counsel at some length. The grievance of the petitioner is that against the approval of building plan of the respondent No.2, he had made representations on 14-12-1992 and on many subsequent dates to the respondent No. l but he was not heard in the matter before the restoration of the approved building plan which at one stage was cancelled. The prayer made in this petition is that "a direction be issued to the respondent No. l to carry out and perform its statutory duties and in performance of their such duties, restrain the respondent No.2, his servants, his men, his agents, his contractors, and successors from raising unauthorised and illegal constructions, sealing the premises and demolishing the illegal structures raised by him on a portion of Plot bearing No.SR-8/18, Hassan A.I Effendi Road, Karachi". A further prayer to the effect that respondent No. 1 may not revive the approval of the building plan, is made.

Mr. Iqbal Memon learned Advocate for respondent No. l states that if there are any representations made by the petitioner, the same would be considered in accordance with law and disposed of within one month from today. As to the prayer clause made by the petitioner, Mr. Iqbal Memon says that the respondent No.1 would perform its due statutory duties strictly in accordance with law and if the respondent No.2 carries on any construction in deviation of the approved plan or in violation of the building laws, an appropriate legal action would be taken against him. This satisfies the learned counsel for the petitioner.
3. The petition is disposed of in the above terms but in the circumstances of the case, there shall be no order as to costs.
