1. KHALIL-UR-REHMAN KHAN, C.J.---The relevant facts have been ' noted by the learned Single Judge in the impugned judgment and the same need not be reiterated. The question agitated before us is that the order of the appellant for permanent absorption having been issued and he having been permitted to be permanently absorbed by the Chairman vide order dated 29-2-1992, neither the Board could legally refuse the permanent absorption vide minutes of meeting dated 3- 5-1992 nor the Secretary Education recall the order of absorption vide impugned order dated 21-5- 1992. The main stress of the learned counsel for the appellant is on the principle of locus poenitentiae. It was further argued that under section 12(8) of the Punjab Board of Intermediate and Secondary Education Act, 1976, the controlling authority has the power to appoint any person in the service of Pakistan against any post in Board. The power of controlling authority is not in issue. The principle of locus poenitentiae does not apply as the order of absorption was to take effect on the expiry of period of deputation. This period was to expire on 23-5-1992. Even the Chairman in his order dated 21-3-1992 had specifically stated that he is being allowed to work permanently in anticipation of the approval of the Board. The Board, however, did not agree with the absorption and it required the controlling authority to withdraw its order-dated 24-3-1992. The controlling authority admittedly recalled his order on 21-5-1992 at the the when the period of deputation had not yet expired. The appellant has no vested right to seek absorption against a post in the Board. He having not been absorbed permanently cannot claim to remain posted against the post of Director, Physical Education of the Board. The repatriation directed in the circumstances is justified in law. We do not, therefore, find any justification to differ with the view, which prevailed with the learned Judge in Chamber. The appeal has no merits and the same is hereby dismissed with no order as to costs.
