DECISION This Revision Application arises from the order of Fifth Sind Labour Court, Karachi, dismissing the application under section 51 of the I.R.O., 1969 for want of jurisdiction.
2. Applicant Muhammad Yaqoob was a permanent workman in the respondent-factory situated at Hub, District Lasbella in Baluchistan Province. The Head Office of this company was situated at Karachi. A settlement had been arrived at between the labour and the management of the factory for payment of certain allowances. The Head Office was at Karachi and was governed by the Shops Act having a few employees. The application before the Fifth Sind Labour Court, Karachi filed by Muhammad Yaqoob was dismissed for want of territorial jurisdiction. The factory unit employing the requisite number of workers and entering into the settlement between the workers and the management cannot be considered as part of the unit at the Head Office in Karachi employing less than 20 workers. Each unit of establishment has to be considered separately. The application was therefore rightly dismissed by the Labour Court and I can see no reason to interfere.
