DECISION Appellant was appointed as an electrician in the respondents' Bank on 30-1-1989 on probation for a period of six, months which could be extended in writing by the Bank. The appellant successfully performed his duties during the period of probation and the Regional Manager by letter dated 28- 7-1991 recommended his case for bringing him in the regular scale since he was working satisfactorily since the date of his appointment on 3-1-1989.

Under the Regulations of Agricultural Development Bank when the worker has fulfilled the conditions of six months' probation and earned a recommendation that his work was satisfactory during that period and the probation having not been extended during those six months, the worker is entitled to be regularised on completion of the probation. The Bank cannot keep him on probation for an indefinite period.
3. I have heard Mr. S. Jehangir Hussain Shah for the respondents bank. He says that the appellant was appointed as purely temporary hand on work-charged basis though the order of his appointment shows that he was appointed on probation for a period of six months, Mr. S. Jehangir Hussain Shah has not been able to produce any letter or document in support of his contention. On the other hand there is letter of Appointment on record and P also the letter of recommendation for confirmation by the Regional Manager.
4. The decision of the VIth Sind Labour Court, Hyderabad is accordingly set aside and the appeal is allowed. The Bank is hereby directed to regularise the appointment of the appellant within a period of 30 days.
