The petitioner has come to this Court for his release on bail after his failure in the two lower forums in a case registered under section 324/34, PAC with allegations of effective firing at the complainant.
2. The learned counsel for the petitioner's contention was that the injuries are not such which proved dangerous or on the vital part on the body. His other contention was that the petitioner is an infirm person being of age of more than 70 years in which respect he produced a medical certificate showing him to be suffering from senile macular degeneration with weak eyesight.
3. In view of the direct charge for effective firing at the complainant the petitioner is not entitled to the concession of bail on merits of the case. However, he can agitate his such plea of infirmity before the lower forums afresh as no prayer of such a ground was made before the lower forums and it would not be appropriate to release the petitioner on bail on the basis of such a plea and with a medical certificate without proper scrutiny in a proper manner by the Courts below.
4. Consequently, this petition has got no force and is dismissed as such.
