DECISION The petition of Arman Khan for reinstatement in the Saudi Arabian Airlines has been dismissed by the Labour Court on the ground that Saudi Arabian Airlines are exempted from the application of provisions of the Standing Orders Ordinance, 1968. The petitioner has accordingly appealed.
2. It is the case of the petitioner that at the the of the alleged incident of smuggling this exemption notification had not come into force.
3. Mr. Faruq A. Ghani for the Saudi Arabian Airlines has, however, argued that the incident occurred on 2nd August, 1994 while the notification in question appeared in the Sind Government Gazette of July 20, 1994 and the notification was in continuation of the previous Notification, dated 30th November, 1993.
4. Under the circumstances the contention of Mr. Gohar Iqbal before the Labour Court has no force.
The petition of Arman Khan was not maintainable before the Labour Court and it was rightly dismissed.
5. This appeal is, therefore, rejected.
