KHALIL-UR-REHMAN KHAN, J.---This appeal was directed against the judgment dated 22-11-1976 passed by a learned Single Judge of this Court whereby three connected writ petitions (W.Ps.
Nos.349, 402 and 919 of 1972) were accepted.
2. This appeal was filed against the judgment passed in Writ Petition No.349 of 1972. Mr. Abdul Hayee Mansoor, learned counsel for legal representatives of Nisar Ahmed Qureshi, writ petitioner in W.P. No.919 of 1972 raised a preliminary objection as to maintainability of the appeal. He argued that failure to challenge the judgment passed in his petition (919 of 1972) is fatal as the said judgment has attained finality and the present appeal, therefore, cannot succeed. Learned counsel for the appellants has no answer to the aforesaid objection. Only one appeal was filed against the judgment passed in W.P. No.349 of 1972. The judgment passed in two connected writ petitions has neither been challenged by filing separate appeals nor in the present appeal, the writ petitioners in the two connected writ petitions were impleaded as respondents. The judgment passed in both the said petitions have, thus, attained finality and a valuable right has come to vest in the said writ petitioners in the connected writ petitions. One appeal filed as such is infructuous as in any case, the impugned order as against other respondents has become final. The objection, therefore, prevails and the appeal is dismissed with no order as to cost.
