Sohrab Khan, petitioner, has filed this petition under section 497/498, Cr.P.C. For the grant of post- arrest bail being accused in case F.I.R. No.37, dated 14-9-1995 registered under section 302/201/34, P.P.C. With Police Station Jaura Kalan, District Khushab.
2. According to F.I.R. The allegation against the petitioner is that he abetted the co-accused in digging the ditch.
3. In support of the petition learned counsel contended that the allegation against the petitioner is baseless and ill-founded. Further, contended that provisions of section 201, P. P. C. Are not attracted as there is no evidence at all which could lead to the conclusion that the petitioner has caused disappearance of the evidence of the offence and that the offence does not fall within the prohibitory clause.
4. I have heard the arguments advanced by the learned counsel for the petitioner. The offence with which the petitioner stands charged is bailable. Grant of bail in such like matters is not a grace but a right. This being so, dispensing with the requirement of notice to State, I admit the petitioner to bail subject to his furnishing bail bonds in the sum of Rs.50,000 with one surety in the like amount to the satisfaction of trial Court; Khushab at Jauharabad. revisions by the competent authorities.
