ORDER ORDERD KHALID PALL KHAWAJA, J.- A compromise has been effected between the parties, namely, the appellant and the heirs of Jaffar deceased through the respectables of the locality and elders of the fraternity. The heirs of Jaffar son of Naurang deceased are as follows:
1. Mst. Maryan (widow)
2. Allah Yar alias Agha (major son)
3. Shah Behram alias Sarfraz (major son)
4. Khizar Hayat aged 15 years (minor son)
5. Khan Bahadur aged 13 years (minor son)
6. Mst. Jannat Bibi (major daughter)
7. Mst. Sardaran Bibi (major daughter)
8. Mst. Iqbal Bibi aged 10 years (minor daughter).
2. Ameer Hamza complainant the brother of the deceased is also present in Court. .
3. Haji Munawar Ahmed and Nisar Ahmed Pannu, MNAs of the District have issued a certificate that the above-mentioned persons are the heirs of Jaffar deceased and that a compromise has been effected between the parties through the efforts of elderly persons of the locality, It is further certified that the heirs of the deceased and minor children of the deceased through Mst. Maryan" who is their natural guardian have been adequately compensated. Mst. Maryan widow of the deceased is present in Court. She admits the execution of the receipt dated 5-3-1994 attested by Rai Salahuddin, ex-MNA and Rai Riaz AM, ex-Councillor of the area. She admits having received by way of compensation 15 buffaloes and 6 cows of the value of Rs. 1,80,000/-. The necessary proforma has also been submitted which is signed by the learned counsel for the appellant. .
4. Comportment deed has also been filed which is thumb marked by Sarfraz a relative and Mst.
Allah Jawa wife of the appellant on behalf of the accused party and on behalf of the heirs of the deceased it is thumb marked by his widow Mst. Maryan and son Allah Yar who are present in Court.
5 Affidavit of Mst. Maryan widow of the deceased, on her own behalf and on behalf of her minor children Khizar Hayat, Khan Bahadur and Mst. Iqbal Bibi alongwith affidavits of Allah Yar alias Agha, Mst. Jannat Bibi, Mst. Sardaran Bibi. Shah Behram alias Sarfraz and Ameer Hamza the complainant, brother of the deceased have also been filed. The executants admit them.
6. From what has been stated above I am satisfied that a compromise has been effected between the parties. The heirs of the deceased have been adequately compensated, It has been agreed that other criminal cases between them would be withdrawn. Hopefully this will end long-standing enmity and blood feud between the parties which has taken seven lives, In view of the compromise effected between the parties the appeal is allowed and the appellant Shaman is acquitted. He shall be released forthwith if not required in any other case.
