' The petitioners claim to be the untrained teachers of Government recognized schools with the alleged qualification to appear in the C.T. Examination as private candidates. Their prayer in the matter has been refused by the respondents and they have invoked the Constitutional jurisdiction of this Court to get the proposed relief that they are entitled to appear as untrained teachers in the C.T. Examination. The comments have been sent by the Chairman, Board of Intermediate and Secondary Education, Multan who has expressed therein that according to notification dated 18-5- 1993 the petitioners being the untrained teachers of the private registered schools are not entitled to A appear as the private candidates for C.T. Examination.
2. I have heard the preliminary arguments addressed by the learned counsel for the petitioners who mainly canvassed before me that the petitioners are entitled to appear in the C.T. Examination as the untrained teachers while they are working in the Government registered schools. In my view the relevant notification dated 18-5-1993 being reproduced as under shall resolve the controversy:- - "GOVERNMENT OF THE PUNJAB EDUCATION DEPARTMENT NOTIFICATION ' No S.0 (BOARDS) 1-131/92.--The Controlling Authority of the Punjab Boards of, Intermediate and Secondary Education, has been pleased to decide that henceforth P.T.C., C.T., O.T. And Arts and Crafts Examinations which were previously being conducted by their respective Directorate of Education (Schools) would now be conducted by the respective Board of Intermediate and Secondary Education in the Punjab under the following conditions:--
(i) The Boards would conduct examination of P.T.C./C.T. Of those students only, who are admitted in the Government Institutions. Private students would not be eligible for the said Examination.
(ii) Syllabi and courses of studies will remain same.
(iii) Examination fee for P.T.C. Would be charged equal to the fee of Matriculation Examination.
Similarly, the candidate for C.T. Examination would pay examination fee equal to the fee being charged from the students of FA/F.Sc.
(iv) Examination schedule would, however, be determined by the respective Boards in consultation with the respective Directorate of Education (Schools).

2. Following Notification dated 24-7-1993 is also relevant is the matter:-- "GOVERNMENT OF THE PUNJAB EDUCATION DEPARTMENT.
NOTIFICATION ' No, S.O. (BOARDS) 1-131/92.--In continuation of this Department's Notification of even number dated 18-5-1993, the Controlling Authority of the Punjab Boards of Intermediate and Secondary Education has been pleased to allow the in-service trained P.T.C. Teachers to take C.T., O.T. And Arts and Crafts Examinations conducted by the respective Board of Intermediate and Secondary Education in the Punjab.

3. Further Notification dated 17-8-1993 provides as under:- "GOVERNMENT OF THE PUNJAB EDUCATION DEPARTMENT.
NOTIFICATION ' NO. S.O. (BOARDS)1-131/92.--The Controlling Authority of the Punjab Boards of Intermediate and Secondary Education/Government of the Punjab has been pleased to allow the in-service untrained teachers working in Government Schools (Provincial/Federal), Local Body (Metropolitan Corporation, Corporations and Town committees) to appear as private candidates in C.T. O.T. P.T.C. And Arts and Crafts Examinations to be conducted by the Boards subject to their eligibility to be determined by the concerned authority.

5. In the aforesaid notifications the untrained teachers working in Government recognized schools have not been included. This is the crux of the matter to make me hold that the petitioners are not entitled to appear as the private candidates in C.T. Examination.
6. Hance relying on the aforesaid all the Notifications which were issued before the bringing of this writ petition, I hold that the petitioners have no case and this writ petition is dismissed in limine.
