ORDER KHILALUR REHMAN RAMDAY, Shabhir and Tanvir petitioners who are real brothers inter se and Imran petitioner who is a son of Shabhir petitioner stand accused of having mounted an assault on Haji Habib-ur-Rehman who is another real brother of Bashir and Tanvir petitioners and having consequently caused injuries on his person on account of some alleged dispute relating to the joint property owned by the said brothers.
2. The learned counsel submits that the offences alleged against the petitioners did not fall within the prohibitory clause and that none of the three petitioners were burdened with specific injuries on the person of Habib-ur-Rehman P.W.
3. The said P.W. Had received 11 injuries on his person. According to the FIR the three petitioners were beating up the said victim after closing the door which victim was then liberated through the intervention of the complainant and others. Even if it is conceded for the sake of arguments that the offence did not fall within the. Prohibitory clause the fact remains that the person accused of such like offence are not entitled to the automatic grant of bail. The petitioners had been arrested at the spot.
4. Totality of the allegations and the attending circumstances do not persuade me to allow the concession of bail to the petitioners and this petition is therefore, dismissed.
