DECISION ' This appeal arises from order of the 5th Sindh Labour Court, Karachi, dismissing the grievance petition of the appellant as time-barred.
2. The facts in brief are that the appellant was employed as a fitter in Pakistan Railways, Karachi City. He retained 30 days' leave for visiting his mother in Kohat in July, 1980. He eventually reported for duty on 6-4-1984 after nearly four years but he learnt that his services have been terminated so he started sending representations to Railway Authorities including the Minister but without success. He ultimately sent his grievance notice on 3-11-1994 some 10 years after his dismissal.
Thereafter, he filed his grievance petition. The Labour Court found that his representations could not extend the period of limitation for the grievance notice. He had to file it within three months from the date of grievance. The grievance petition was not, therefore, maintainable.

It had been argued by Mr. M.A. Hassan Malik on behalf of the appellant that the appellant came to know about his dismissal only when he reported for duty on 4-4-1984 but he continued making representations for the next 10 years and eventually sent his grievance notice by registered post on 3-11-1994. That on account of his departmental appeal the grievance notice was sent within three months after waiting for 10 years for result of his appeals. The grievance notice is obviously time- barred.
4. I find no substance in this appeal which is dismissed in limine.
