ORDER

RAZA ALI, MEMBER.- This revision petition has been filed for grant of proprietary rights of the land in dispute under Notification of 20-4-1983.

2. Brief facts of the case are that according to the petitioner, they were allotted state land measuring 128 kanals and 160 kanals respectively in Chak No.12-A/TDA, Tehsil and District Bhakkar, under temporary Lease Scheme in 1971. They claim to have applied to the E.A.CO, Bhakkar for grant of proprietary rights of the said land under Notification of 20-3-1983, but their request remained unattended. They have, therefore, requested for grant of proprietary rights under the above said notification. I have fixed the case in mypeshi on the judicial side.

3. I have heard arguments of the learned counsel for petitioners and have perused the record available in this file.

In this case the petitioners claim for grant of proprietary rights under Notification of 20-3-1983 appears to be unwarranted because we cannot go back 12 years, especially when new scheme has recently been invoked. Their case is, therefore, remanded to the Assistant Commissioner Collector, Bhakkar, who should consider the eligibility of the petitioner treating this application for grant of proprietary rights under the New Scheme. It is, however, observed that the petitioners cannot be granted proprietary rights over and above the ceiling of subsistence holding i.e. I00 kanals each.
