JIWAN KHAN, MEMBER.- This is a revision petition against the order dated 4.4.1993 of Additional Commissioner (Revenue), - Bahawalpur Division, whereby he accepted the appeal filed by Muhammad Ismail s/o Muhammad Din (predecessor-in-interest of the present respondents) against the order dated 4.5.1992 of AC/Collector, Haroonabad, through which his application for sanction of a public path through Killah No. 5 of Square No. 29 of Chak No. 98/6-R, Tehsil Haroonabad was rejected. Additional Commissioner accepted the appeal and sanctioned two karams wide public path running from East to West in Killa No. 5 of Square No. 29, on the condition that 9 marlas out of Killa No. 4 owned by Muhammad Ismail shall be transferred in favour of Muhammad Yousaf etc., the present petitioners.
2. Muhammad Ismail has since died and his legal heirs Mst. Parveen Akhtar widow and his minor children have since been impleaded. Mst. Parveen Akhtar on her behalf and on behalf of her minor children has appointed Rafi Ullah s/o Inayat Ali as a Special Attorney who has submitted in writing that the parties have entered into a compromise through which it has been decided that the public path sanctioned by Additional Commissioner may be got cancelled. The compromise deed duly authenticated by the learned counsels of the parties has been presented which is placed on record.
3. In terms of the compromise, the revision petition is accepted and the order dated 4.4.1993 of the Additional Commissioner (Revenue), Bahawalpur Division, is set aside.
