ORDERJIWAN KHAN, MEMBER.- This is a revision petition against the order dated 28-2-19911 of Additional Commissioner (Cons:), Multan Division, whereby he rejected the appeal filed by the present petitioner against the order dated 15-5- 1990 of AC/Collector, Burewala, through which 10 marlas in Khasra No. 11/22 in Chak No. 46/EB, Tehsil Burewala, District Vehari, were allotted in favour of respondent Muhammad Shahbaz under Punjab Jinnah Abadis for Non- Proprietors in Rural Areas Act, 1986.

Section 9 of Punjab Jinnah Abadis for Non-Proprietors in Rural Areas Act, 1986, clearly prescribed that an appeal against the orders of AC/Collector shall lie before the Deputy Commissioner whose orders would be final. The order dated 15-5-1990 could have been challenged only before the Deputy Commissioner. The appeal before the Additional Commissioner was not competent. The impugned order dated 28-2-1991 is thus of no legal consequence. The order dated 15-5-1990 of AC/Collector passed under Punjab Jinnah Abadis for Non-Proprietors in Rural Areas Act, 1986, would however, remain in tact unless the same is modified by Deputy Commissioner through his appellate jurisdiction.
