DECISION ' This appeal is directed against the order of Fourth Sindh Labour Court, Karachi whereby the grievance petition of the appellant was dismissed.
2. It is the case of the appellant that he was transferred from Metropolitan Steel Corporation Limited to Pakistan Steel Mills. He was working as a driver at both the mills. His service conditions were to remain unaltered. He has however been deprived of his consolidated seniority and Scale of Pay to which he would have been entitled had he not been transferred. The learned Labour Court found that the benefits claimed by the petitioner were not under any law, award or settlement and they could not, therefore, be agitated in a petition under section 25-A of the I.R.O. He was also of the view that the grievance notice and petition were both time-barred. The petition was, therefore, dismissed.
3. Mr. Ashraf Hussain Rizvi for the appellant has made a statement that one of the two grievances namely the recognition of the total length of service including the services in the Metropolitan Steel Corporation has been allowed by the Pakistan Steel Mills and the question of Scale of Pay is also under consideration of the Steel Mills Corporation and they are likely to grant this benefit also to the appellant. It is hoped that the dispute would be amicably settled and there will be no further necessity of approaching the Courts. This appeal is accordingly dismissed.
