DECISION ' The appellants were permanent employees of respondent-Corporation for manufacturing tents and employed about 500 workers. On account of reduction in the orders of tents from abroad the management was compelled to reduce about 69 workers on the ground of re-organization. Out of the workers whose services were terminated under Order 12(3) of the Standing Orders Ordinance, 1968, 28 have preferred this appeal. At the stage of this appeal before the Tribunal two more workers Muhammad Riaz at Serial No, 11 and Muhammad Sulaiman at Serial No, 18 have withdrawn the appeals for the reason that they have ' settled their disputes with the management. Therefore, there now remained only 26 appellants still desiring to prosecute these appeals.

The contention of the appellants is that their termination was mala fide as the election of their C.B.A. Was going to take place and the management wanted to reduce a number of workers who were likely to vote for the C.B.A. Whom they did not want. The learned Labour Court came to the conclusion that the election of the C.B.A. Had nothing to do.With retrenchment of these workers which was bona fide according to the re-organisation scheme due to lack of orders.

I agree with the finding of the Labour Court and the same point that election of C.B.A. Is not responsible for termination of services of the workers and the management have every right to effect economy on account of losses and reduce the number of workers under Order 12(3) of the Standing Orders Ordinance.

As regards the payment of legal dues Mr. Latif Saghar states that they were ready and willing to pay their legal dues but they declined to accept the same as they wanted to file their grievance petitions. That even now they are ready to pay them the legal dues. The learned Advocate for the appellants contends that he is willing to withdraw the appeals only after the payment of the legal dues.
5. Under the circumstances the decision of the Labour Court is maintained and the remaining appeals are dismissed. The respondent-management are directed to pay the legal dues to the remaining appellants within thirty days from the date of this order.
