' This is an application filed under section 497(5), Cr.P.C. For cancellation of pre-arrest bail granted to respondents Nos.1 to 5, by learned Additional Sessions Judge, Lahore vide his order dated 5-9- 1994.
2. Facts leading to this petition are that Muhammad Saleem petitioner lodged F.I.R. No, 100 on 10-6- 1994 against the respondents on the allegation that his wife Mst. Zohra Syed had been abducted by them and after the aforesaid abduction, Akhtar Ali developed illicit relations with the/ abductee, wife of the petitioner. Mst. Alia, who is wife of the brother of Akhtat. Ali, is the real sister of the abductee. Learned Additional Sessions Judge,. Granted pre-arrest bail, inter alia, on the consideration that in her statement recorded under section 164, Cr.P.C., the abductee had stated that she had not been abducted.
3. Today it has been brought to my notice that the alleged abductee (Mst. Zohra Syed) has filed a suit for dissolution of her marriage against the petitioner. The Investigating Officer who is present in Court alongwith record, has stated that the accused in this case has been found to be innocent and a report for cancellation of the F.I.R. Has already been made vide Zimine, dated 5-10-1994.
Prima facie, it appears to be matrimonial dispute, I do not feel persuaded to cancel the bail granted to the respondents. Accordingly, this application is dismissed. revisions by the competent authorities.
